PRESS RELEASE

Sacramento, California April 30, 2015 10:30 AM

“However misguided or contemptuous for the First Amendment rights of others who gathered at our permitted event, it was not our wish to see a 20 year old young person’s future blemished by a felony conviction” David Jenest, CEO Patriot Defenders Network, Inc. said today after Maile Hampton’s court appearance. “Early on, I had made this position clear to Deputy DA Michael Kane. As the target of Miss Hampton’s feelings about police and our support of them, I felt we needed to have a voice in the case.”

The District Attorney has yet to decide if the nonprofit corporation has standing under Penal Code Sections § 679.02 and § 1102.6 and to address the court at Miss Hampton’s sentencing if convicted of the sole remaining misdemeanor charge of interfering with a police officer.

“One might go so far as to suggest, if Sacramento Police officers whose Command Staff knew well in advance, the plans of Ms.Hamton’s group to disrupt and interfere with our Rally to Support Our Law Enforcement Officers  had failed to act, Penal Code section 410 might apply.”

“PC 410. If a magistrate or officer, having notice of an unlawful or riotous assembly, mentioned in this Chapter, neglects to proceed to the place of assembly, or as near thereto as he can with safety, and to exercise the authority with which he is invested for suppressing the same and arresting the offenders, he is guilty of a misdemeanor.”

The larger issue here is not about Miss Hampton’s alleged offenses but the rule of law meant to protect all citizens First Amendment rights.  When one group bans together, conspires to disturb or interfere with another group’s solemn ceremony, especially one at the California Pease Officers Memorial, action by police officers is appropriate and expected.

403.  Every person who, without authority of law, willfully disturbs or breaks up any assembly or meeting that is not unlawful in its character, … is guilty of a misdemeanor.

 

407.  Whenever two or more persons assemble together to do an unlawful act, or do a lawful act in a violent, boisterous, or

tumultuous manner, such assembly is an unlawful assembly.

Contrary to public statements to the media and before the Sacramento City Council, the nonprofit permit holder applied for and was granted a street closure permit to allow rally participants to move freely between the west steps of the capital and the memorial. Among those in attendance were the families of fallen law enforcement officers in our region.

Unlike the landmark United States Supreme Court case Snyder v. Phelps in 2011 in which the Court held that speech on a public sidewalk was protected, the hosts of the event paid the fees required by the City of Sacramento and the police officers tasked with securing 10th Street between L and N Streets. The protesters did exercise their First Amendment right to free expression along L Street.

As expected, no response from the Media to our side!

 

This is my only way to express our thoughts on this matter prior to sentencing if she is convicted on remaining charge.

Does Ms. Hampton’s statement after court reflect any contrition?

If you ain't in the streets WITH THE PEOPLE and instead telling the people to get in the streets, while you sit back out of harms way, if you try to take control of EVERY situation and every person, if you don't get out there and support activists being targeted, if you say one day you're revolutionary then turn around encourage talking to the cops, the same ones oppressing us DAILY, have a seat. Have about 6 seats. Thank you . We are MILITANT, We are STRATEGIC, and we care for the community and SAFETY of our people. And will shut it down with strategy, intelligence, and with the mass.”
